Terms of Service
Effective August 17, 2026
These Terms of Service (the "Terms") are a binding agreement between you and BuildMyMap LLC, a North Carolina limited liability company ("BuildMyMap," "we," "us," or "our"). They govern your access to and use of buildmymap.com, the BuildMyMap service, and any related tools, dashboards, embeds, and content (together, the "Service").
By creating an account, paying a fee, or using the Service in any way, you agree to these Terms and to our Privacy Policy and Refund & Cancellation Policy, each of which is part of this agreement. If you do not agree, do not use the Service.
1. Who may use the Service
You must be at least 18 years old. If you register on behalf of a business, you represent that you are authorized to bind it, and "you" means both you and that business. The Service is intended for business use, not personal or household use.
2. What the Service is
BuildMyMap creates a branded live location map for mobile and location flexible businesses. The map can sync to a calendar feed you provide, can be embedded on your website, and can be shared as a link. It may display supporting information such as upcoming stops, address locations, weather, and third party map imagery.
The Service depends on data and feeds that you control, including your calendar feed. We are not responsible for the accuracy, availability, or content of your calendar feed or any other third party data you connect.
3. Your account
You agree to provide accurate information and keep it current. You are responsible for keeping your credentials and any access codes confidential, and for all activity under your account. Tell us promptly at info@buildmymap.com if you suspect unauthorized use. We store your password only in securely hashed form and cannot recover it in plain text.
4. Fees and billing
Setup fee. A one time setup fee, which includes your first month of service.
Monthly subscription. After the first month, the Service continues on a recurring monthly basis at the rate shown at checkout when you signed up.
Founding rate. As a launch offer, a limited number of early clients lock a founding rate for as long as their subscription stays continuously active. If a founding rate subscription is cancelled or lapses, the founding rate ends, and any later signup is at then current pricing. The founding rate applies to the recurring monthly fee only and creates no other guarantee about features or service levels.
Payment processing. All payments are processed by Stripe. By providing payment information you authorize us and Stripe to charge the applicable fees. BuildMyMap never sees or stores your full card number.
Taxes. Fees do not include sales, use, or similar taxes, which are your responsibility unless we are legally required to collect them.
5. Automatic renewal
PLEASE READ CAREFULLY. YOUR SUBSCRIPTION AUTOMATICALLY RENEWS. YOUR SUBSCRIPTION IS A MONTH TO MONTH PLAN THAT AUTOMATICALLY RENEWS EACH MONTH UNTIL YOU CANCEL. WE WILL AUTOMATICALLY CHARGE YOUR PAYMENT METHOD AT THE START OF EACH MONTHLY CYCLE, WITHOUT FURTHER NOTICE, UNTIL YOU CANCEL. THERE IS NO FIXED END DATE.
You may cancel at any time, and cancellation stops future renewals. Because billing is monthly, the current month is not prorated when you cancel. See the Refund & Cancellation Policy for how to cancel and what happens to your map.
6. Price changes
We may change the recurring subscription fee. We will give at least 30 days advance notice by email or through the Service, and the new price applies to your next billing cycle after that notice period. If you do not agree, your remedy is to cancel before the change takes effect. Founding rate clients keep their rate under Section 4 while continuously active.
7. Your content and your logo
As between you and us, you own everything you provide, including your logo, business name, and stop information ("Client Content").
You grant BuildMyMap a limited, non exclusive, worldwide, royalty free license to host, store, reproduce, resize, and display your Client Content solely to operate, provide, and support the Service and your map. This license lasts while your account is active and for a reasonable wind down and backup period afterward.
You represent and warrant that you own or have all necessary rights to your logo and all Client Content, and that our display of it will not infringe any third party's intellectual property, privacy, publicity, or other rights. You are solely responsible for your Client Content.
8. Acceptable use
You agree not to use the Service to:
- break any law, or promote or facilitate illegal activity;
- post content that is fraudulent, deceptive, defamatory, harassing, hateful, obscene, or that exploits minors;
- infringe anyone's intellectual property, privacy, or publicity rights;
- publish a location you are not authorized to operate from, or knowingly publish false locations;
- upload malware, attempt to gain unauthorized access to the Service or its data, probe or scan our systems, or interfere with or overload the Service;
- scrape, resell, sublicense, or redistribute the Service or its data except through the embed and share features we provide;
- remove, obscure, or alter the OpenStreetMap attribution, the BuildMyMap credit, or any other required attribution; or
- misrepresent your identity or your affiliation with any person or business.
Violations may result in suspension or termination under Section 13.
9. Appointment booking add on
The appointment booking add on is an optional paid feature that is off by default. If you enable it, visitors to your map can book a slot by entering their name and phone number, which we store and email to you.
For that booking information, you are the data controller and BuildMyMap is the data processor. You decide why and how it is collected and used, and we process it only on your behalf. You are responsible for having a lawful basis and giving any required notices, for responding to your visitors' privacy requests, and for using the information only for legitimate booking related purposes. We do not sell or share booking information for anyone else's commercial use.
10. Map data and attribution
Maps are built using third party data and imagery. Map data is copyright OpenStreetMap contributors and is made available under the Open Database License, and is displayed with attribution on every map. The Service also uses tile, geocoding, and weather data from the providers described in our Privacy Policy. Your use is subject to the applicable third party terms and attribution requirements.
11. No uptime guarantee, and the Service is provided "as is"
We work hard to keep the Service available, but we do not guarantee uptime or availability, and we do not guarantee that the Service will be uninterrupted, timely, error free, or secure. The Service depends on third party providers, on the public internet, and on feeds and websites that you control. The Service may be unavailable for maintenance, upgrades, provider outages, or causes outside our reasonable control.
TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL MEET YOUR REQUIREMENTS, THAT MAP OR LOCATION DATA IS ACCURATE, OR THAT ANY DEFECT WILL BE CORRECTED.
Some jurisdictions do not allow certain warranty exclusions, so some of the above may not apply to you.
12. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, BUILDMYMAP LLC AND ITS OWNER, MEMBERS, EMPLOYEES, CONTRACTORS, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOST PROFITS, LOST REVENUE, LOST SALES, LOST CUSTOMERS, LOST OR CORRUPTED DATA, LOST GOODWILL, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY.
THIS INCLUDES, WITHOUT LIMITATION, ANY LOSS OF BUSINESS, LOST SALES, OR MISSED CUSTOMERS ARISING FROM THE MAP BEING UNAVAILABLE, DELAYED, INACCURATE, OR SHOWING AN INCORRECT OR OUTDATED LOCATION, FOR ANY REASON.
OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS WILL NOT EXCEED THE GREATER OF (I) THE TOTAL FEES YOU PAID TO US IN THE THREE (3) MONTHS IMMEDIATELY BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (II) ONE HUNDRED U.S. DOLLARS ($100).
These limitations apply regardless of the theory of liability and are a fundamental basis of the bargain between us. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
13. Suspension and termination
We may suspend or terminate your access if you breach these Terms, if your payment fails or is reversed, if we reasonably believe your use poses a security, legal, or reputational risk, or if we are required to by law. Where practical and lawful, we will try to give you notice first.
You may terminate by cancelling as described in the Refund & Cancellation Policy. On termination your right to use the Service ends and your map is taken offline. Sections that by their nature should survive, including Sections 7, 11, 12, 14, and 15, and any fees you owe, will survive.
14. Indemnification
You agree to defend, indemnify, and hold harmless BuildMyMap LLC and its owner, members, employees, contractors, and agents from any claims, damages, liabilities, losses, and expenses, including reasonable attorneys' fees, arising out of your Client Content including your logo, your use of the Service, your map and anything published through it, your collection and use of appointment booking information, your violation of these Terms or any law, or your violation of any third party right.
15. Governing law and venue
These Terms are governed by the laws of the State of North Carolina, without regard to its conflict of laws rules. The state and federal courts located in New Hanover County, North Carolina have exclusive jurisdiction over any dispute arising out of these Terms or the Service, and you consent to venue there.
16. Our intellectual property
The Service, including its software, design, and look and feel, excluding Client Content and third party data such as OpenStreetMap data, is owned by BuildMyMap LLC or its licensors. We grant you a limited, non exclusive, non transferable, revocable right to use the Service during your subscription. You may not copy, modify, distribute, sell, or create derivative works from it except as expressly allowed. Any feedback you send us may be used without obligation to you.
17. Copyright complaints
If you believe material on the Service infringes your copyright, email info@buildmymap.com with a description of the work, the location of the material, your contact information, and a statement of good faith belief that the use is not authorized. We may remove material and terminate repeat infringers.
18. Changes to these Terms
We may update these Terms. For material changes we will post the updated Terms with a new effective date and, where appropriate, notify you. Changes take effect when posted or on a later stated date. Continuing to use the Service after that means you accept them. If you do not agree, stop using the Service and cancel.
19. General
- Entire agreement. These Terms and the policies referenced in them are the entire agreement about the Service.
- Severability. If any provision is unenforceable, the rest stays in effect.
- No waiver. Not enforcing a provision is not a waiver of it.
- Assignment. You may not assign this agreement without our consent. We may assign it, including in a merger or sale of the business.
- Force majeure. Neither party is liable for delays or failures beyond its reasonable control.
- Relationship. The parties are independent contractors.
- Notices. We may notify you by email or through the Service. Legal notices to us go to the address below.
